2. Services Provided
Blue Quality Lawn Care provides professional lawn care, landscaping, and property maintenance services in Cape May County, New Jersey, including but not limited to:
- Lawn mowing and maintenance
- Spring and fall cleanups
- Landscaping design and installation
- Mulching and bed maintenance
- Yard waste removal
- Seasonal property care
- Other related lawn and landscape services
Services are subject to availability, weather conditions, and seasonal limitations.
3. Service Agreements
3.1 Quotes and Estimates
- Free quotes are estimates only and not binding until confirmed in writing
- Final pricing may vary based on actual property conditions, scope changes, or unforeseen circumstances
- Quotes are valid for 30 days unless otherwise specified
3.2 Service Scheduling
- Services are scheduled based on availability and weather conditions
- We will make reasonable efforts to provide services on scheduled dates
- Services may be delayed or rescheduled due to weather, equipment issues, or other circumstances beyond our control
3.3 Recurring Services
- Recurring service agreements (weekly, bi-weekly, monthly) continue until canceled by either party
- Cancellation requires written notice at least 7 days before the next scheduled service
- Seasonal contracts may have specific start and end dates outlined in your agreement
3.4 Property Access
- You grant us permission to access your property on scheduled service dates
- You are responsible for ensuring safe and clear access to work areas
- You must inform us of any hazards, underground utilities, or special conditions
- Locked gates or obstructed access may result in rescheduling
4. Pricing and Payment
Payment terms, pricing, and accepted payment methods will be provided to you when you receive your service quote or estimate. All payment terms will be clearly outlined in your service agreement.
5. Cancellations and Refunds
5.1 Service Cancellations
- By Customer: You may cancel or reschedule services by contacting us
- We will work with you to find a mutually agreeable solution
5.2 Weather Cancellations
- We reserve the right to cancel or reschedule services due to inclement weather, including rain, snow, extreme heat, or unsafe conditions
5.3 Refunds
- Refunds are issued only for services not rendered or significant service failures
- Refund requests must be made within 7 days of service completion
- Refunds are processed within 14 business days of approval
5.4 Service Guarantee
- We stand behind the quality of our work
- If you are unsatisfied with our service, notify us within 48 hours and we will make it right at no additional charge
6. Customer Responsibilities
You agree to:
- Provide accurate property information and service requirements
- Ensure safe and clear access to work areas
- Mark or identify any sprinkler heads, underground utilities, decorative items, or hazards
- Secure pets during scheduled service times
- Remove or identify any valuable or fragile items from work areas
- Notify us immediately of any property changes, hazards, or concerns
- Pay invoices in a timely manner
Failure to meet these responsibilities may result in service delays, additional charges, or service termination.
7. Warranties and Disclaimers
7.1 Service Warranty
- We warrant that services will be performed in a professional and workmanlike manner
- We do not guarantee specific outcomes (e.g., lawn health) due to factors beyond our control (weather, soil conditions, pests, disease)
- Plant installations carry a 30-day warranty against defects in installation (not natural causes)
7.2 No Other Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.3 Weather and Natural Conditions
- We are not responsible for weather-related delays, natural disasters, or acts of God
- We are not liable for damage to lawns or plants caused by drought, disease, pests, or other natural conditions beyond our control
8. Limitation of Liability
8.1 Liability Cap
TO THE FULLEST EXTENT PERMITTED BY NEW JERSEY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR $500, WHICHEVER IS LESS.
8.2 Exclusion of Damages
WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damage to lawns, plants, or property caused by pre-existing conditions, weather, pests, disease, or customer negligence
- Damage to unmarked sprinkler heads, underground utilities, decorative items, or hidden hazards
- Delays or failure to perform services due to weather, equipment failure, or other circumstances beyond our control
8.3 Insurance
We maintain general liability insurance. Proof of insurance is available upon request.
9. Property Damage
9.1 Marked Hazards
- You must mark or notify us of sprinkler heads, underground utilities, septic systems, decorative items, or other hazards
- We are not liable for damage to unmarked or undisclosed hazards
9.2 Pre-Existing Conditions
- We are not responsible for pre-existing lawn or plant conditions, diseases, or pest infestations
- We will notify you of observed issues but are not liable for their effects
9.3 Damage Claims
- Notify us immediately of any alleged property damage
- Damage claims must be submitted in writing within 48 hours of service
- We will investigate and, if at fault, repair or compensate for damage up to the liability limits outlined in Section 8
10. Intellectual Property
10.1 Website Content
- All content on our website (text, images, logos, graphics, videos) is the property of Blue Quality Lawn Care or our licensors
- You may not copy, reproduce, distribute, or create derivative works without written permission
10.2 Trademarks
- "Blue Quality Lawn Care," "Blue Lawns," and associated logos are trademarks of Blue Quality Lawn Care
- Unauthorized use of our trademarks is prohibited
11. User Conduct
When using our website or services, you agree NOT to:
- Provide false or misleading information
- Violate any local, state, or federal laws
- Interfere with or disrupt our services or website
- Attempt to gain unauthorized access to our systems
- Harass, threaten, or abuse our employees or contractors
- Use our services for any unlawful purpose
Violation of these terms may result in immediate service termination and legal action.
12. Termination
12.1 By Customer
You may terminate recurring services at any time with 7 days' written notice. You remain responsible for payment of services already rendered.
12.2 By Company
We reserve the right to terminate service agreements immediately if:
- You fail to pay invoices
- You violate these Terms of Service
- You engage in abusive or threatening behavior toward our staff
- Property conditions are unsafe or service cannot be reasonably performed
12.3 Effect of Termination
Upon termination:
- All outstanding invoices become immediately due
- You must provide access for equipment or material retrieval
- Prepaid services will be refunded on a pro-rata basis (if applicable)
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
13.2 Informal Resolution
We encourage open communication. If you have any concerns or disputes, please contact us first so we can work together to resolve the issue amicably.
14. Indemnification
You agree to indemnify, defend, and hold harmless Blue Quality Lawn Care, its owners, employees, and contractors from any claims, damages, losses, or expenses (including attorney's fees) arising from:
- Your breach of these Terms
- Your negligence or willful misconduct
- Your failure to disclose property hazards or conditions
- Third-party claims related to your property or conduct
15. Force Majeure
We are not liable for delays or failure to perform services due to causes beyond our reasonable control, including but not limited to:
- Weather conditions (rain, snow, extreme heat, storms)
- Natural disasters (floods, hurricanes, earthquakes)
- Equipment failure or unavailability
- Government restrictions or regulations
- Labor disputes or strikes
- Pandemics or public health emergencies
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to reflect the parties' intent to the extent permitted by law.
17. Entire Agreement
These Terms, along with our Privacy Policy and any service agreements, constitute the entire agreement between you and Blue Quality Lawn Care. They supersede all prior agreements, understandings, or representations.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
